All information provided to Hardwired Hosting UK is used for billing purposes. Hardwired Hosting UK will not share any clients information with 3rd parties. If Hardwired Hosting UK is required to pass on client information to government agencies, for whatever reason, Hardwired Hosting UK will notify the client of the reasoning behind this. Hardwired Hosting UK may be required to provide client information to the authorities if they are found to be breaching applicable laws.
Customer GDPR Data Processing Agreement
This Customer Data Processing Agreement reflects the requirements of the European Data Protection Regulation (“GDPR”) as it comes into effect on May 25, 2018. Hardwired Hosting UK's products and services offered in the European Union are GDPR ready and this DPA provides you with the necessary documentation of this readiness.
This Data Processing Agreement (“DPA”) is an addendum to the Customer Terms of Service (“Agreement”) between Hardwired Hosting UK (“Hardwired Hosting UK”) and the Customer. All capitalized terms not defined in this DPA shall have the meanings set forth in the Agreement. Customer enters into this DPA on behalf of itself and, to the extent required under Data Protection Laws, in the name and on behalf of its Authorized Affiliates.
The parties agree as follows:
GDPR and its role
Under new GDPR rules enforced as of May 25 2018, Hardwired Hosting UK as a data controllor process, store and utilise data provided by clients for the provisioning of their services, all data stored by Hardwired Hosting UK is not shared with 3rd parties unless explicitly outlined or agreed upon, additionally, all data held is available within the client portal at any time for the viewing of said client, we do not store data without the users consent, and under GDPR laws you may request removal of your data if this is appropriate. Hardwired Hosting UK cannot remove the data of clients who have active services or products. In the event of deletion of customer data, Hardwired Hosting UK may retain access logs in relation to the client portal for any period of time at our own discretion. In the event that Hardwired Hosting UK have terminated an account due to breach of policies, Hardwired Hosting UK reserve the right to retain the customer data indefinitely to ensure prevention of a recurring incident in relation to violation of Hardwired Hosting UKs terms or policies in the future.
Hardwired Hosting UK may utilise customer data to occassionally send out marketing emails; this process is done through an opt in either via the client portal at any time, or upon account registration. All marketing emails will contain direct information on how to unsubscribe, and unsubscription is available at any time throughout our client portal.
In the event of data breach, Hardwired Hosting UK will do its utmost to ensure that notification is sent out to affected clients immediately, taking reasonable and necessary measures to do so, said notifications will contain all information necessary as appropriate under the data protection laws and GDPR.

Right to Restrict Processing
You have the right to request we restrict processing of your personal data where there is no legitimate interest for us to do so.
Right of Access to Information
GDPR gives you the right to access information stored about you, all of your data is available within the client portal.
Right to be forgotten
As an individual you have the right to request the removal of any data we hold on you, it does not however override our requirement under UK law to keep financial data such as invoicing and payment information; however personal data can be removed in accordance with the information outlined in our data processing agreement.
You can make a request where your personal data is no longer necessary in relation to the purpose for which it was originally collected/processed, for example if you cancel all services you have with us.
To request removal of your data, please contact us through the relevant account using our support ticketing system.
Right to Rectification
GDPR provides the right to have any personal data rectified that may be incorrect or incomplete.
As a customer, you can update your own personal details via the client area; however if this is not sufficient please contact our customer services team.
Right to Object
You have the right to object to the processing of your personal data where there is no legitimate or lawful reason to do so.

Web Services - Acceptable Use Policy
I. Server Resources
Hardwired Hosting UK reserve the right to suspend or terminate any service abusing server resources. This includes, but is not limited to: CPU Usage, RAM Usage and I/O resources. It is at Hardwired Hosting UKs discretion as to whether a service is abusing server resources.
II. Prohibited Content
Services used by Hardwired Hosting UK are to be used for lawful purposes only, Hardwired Hosting UK strictly forbids the use of our services for anything which may be in breach of the law, this includes, but is not limited to:
Spam E-Mail sending
The discussion of hacking
The storage/use of tools intended for hacking purposes
The storage/use of tools used to disrupt/attack other networks or services
Content that may be in breach of Copyright Laws
The storage or use of child pornography is strictly prohibited
Hardwired Hosting UK reserve the right to take necessary action against service users who are in breach of the Law or any of the points outlined on this page.
III. Malicious Activity
Hardwired Hosting UK strictly prohibits the use of tools/services, or the promotion/discussion of services used to breach, or attack networks/services. Hardwired Hosting UK reserve the right to take action (with or without warning) against the service(s) involved, this may include immediate suspension or termination. It is at Hardwired Hosting UKs discretion as to what classes as Malicious Activity.
IV. Reseller Responsibility
By being a reseller of our services, the reseller account holder is responsible for all of the sub-accounts created under the reseller account. The reseller account holder is responsible for ensuring that all sub-accounts are not in breach of our Terms of Service. Hardwired Hosting UK reserve the right to suspend or terminate the whole reseller account if sub-accounts are in breach of any of the points outlined on this page.
V. Account Transfers
Hardwired Hosting UK offer a free, complimentary account transfer service. Hardwired Hosting UK will transfer individual cPanel accounts free of charge. Hardwired Hosting UK will only transfer accounts from other cPanel servers which have the ability to use the full backup feature. In addition, Hardwired Hosting UK makes no guarantee as to how quickly accounts will be transferred, this is a complimentary service and therefore any other incidents that should arise will take priority.
VI. Free Domain Names
Hardwired Hosting UK offer a free domain name with selected Web/Reseller Hosting Packages. If the free domain name is claimed with a service and the client requests a refund within the first 14 days under our money back guarantee, Hardwired Hosting UK will deduct the normal cost of the domain name off of the refunded amount.

I. Money Back Guarantee
Hardwired Hosting UK offer a 7 day money back guarantee, which is applicable to the following services:

Domain Registrations, Transfers and Renewals
The money back guarantee is offered on all applicable services at Hardwired Hosting UK, however, a different approach is followed dependent on whether or not you've previously held an active service with us.
If you've not previously had an active service with us, Hardwired Hosting UK will issue a full refund via the original payment method for services within our 14 day money back guarantee period, it may take up to 7 working days for the refund to be processed, from the time that a refund is confirmed by the Billing Department; refer to section two for information on our refunds procedure.
If you've previously had a service with us, Hardwired Hosting UK will issue a full refund to your client credit balance for services which are within our 7 day money back guarantee period.
The 7 day money back guarantee is invalid if:
Hardwired Hosting UK suspect the 14 day money back guarantee is being exploited in any way
The client/account holder or user of the service has breached any part of our Terms of Service or Acceptable Use Policy
Hardwired Hosting UK will issue refunds at our sole discretion based on our 7-day money back guarantee policy, official refund requests are only accepted when the client contacts our Billing Department via the Support Ticketing system, any other requests for a refund (including via the Request Cancellation's form) are invalid.
Clients are entitled to cancel their service(s) with us at any time throughout the duration of their billing period, regardless of the billing cycle used. Clients who request a cancellation for services on lengthier billing periods (Quarterly, Semi-Annually and Annually) may request a refund in client credit for the unused months, this is only applicable in line with our 7-day money back guarantee.
IV. Late Payments
Hardwired Hosting UK generates renewal invoices at least 10 days before their due date, clients are therefore responsible for ensuring payments are made before or on the due date, Hardwired Hosting UK will not be held liable for any issues which may occur as a result of late payments. Hardwired Hosting UK will suspend the service if a payment has not been made by the due date, the service will remain suspended for 7 days before being terminated completely.
Clients who leave their services overdue for 4 days or more will incur a late fee of 20% of the total service cost if they wish to renew the service at that time.
V. Updates to Pricing
Hardwired Hosting UK reserve the right to update our pricing structures at any time, at our own discretion. Hardwired Hosting UK will make reasonable attempts to inform clients of updates to our pricing structure, in the event that active services are affected by pricing updates, the new prices will take effect as of the next due date.
VI. Subscriptions & Automatic Payments
Hardwired Hosting UK utilises payment gateways which allow clients to make payments automatically. These are optional, however, clients who opt for automatic payments are responsible for ensuring they cancel the automated payments through their payment gateway account. Any over payments made as a result of failure to cancel automated/authorised payments will automatically be refunded into the client credit balance.
Payments via Debit/Credit Card are processed automatically on the service(s) due date unless the option to not store the card details is selected on checkout, alternatively you may contact the Billing Department to have automatic card payments disabled on your account. By utilising the Debit/Credit Card payment gateway, you agree that Hardwired Hosting UK is authorised to take payments automatically unless otherwise specified and that the client is responsible for cancelling the service before the due date in order to prevent an automatic payment from being processed.
VII. Disputes & Chargebacks
In the event that a dispute or charge back is opened with Hardwired Hosting UK by a client, Hardwired Hosting UK will suspend all services linked with that account, with immediate effect. Hardwired Hosting UK will follow the dispute and charge back procedure via the relevant payment gateway, and depending on the outcome, Hardwired Hosting UK may terminate the client's account and services with immediate effect, or at the end of the billing period for the accounts service(s).
Clients should refrain from opening dispute/charge backs, as this will void your eligibility for a refund, the Billing Department should be contacted directly via our support system for refund requests.
VIII. Backup of Data
Hardwired Hosting UK accepts no responsibility for loss of data, regardless of the cause. Unless otherwise outlined, Hardwired Hosting UK accepts no responsibility for backups of services; clients should use their own methods to regularly take backups of data. In the event that Hardwired Hosting UK offers complimentary backups of particular services, Hardwired Hosting UK makes no guarantee that these backups can be provided, or restored.
By utilising our services, clients are responsible for their actions, data, and services. Hardwired Hosting UK will not be held liable for any content that clients may store or utilise on our systems. Additionally, Hardwired Hosting UK will not be held liable for any losses that clients or users may incur, regardless of the cause; this is including but not limited to: Loss of income, data or traffic.
X. Action Taken
Hardwired Hosting UK reserve the right to suspend, impose limits or terminate services at our own discretion, with or without prior warning to the affected client(s). Hardwired Hosting UK also reserves the right to refuse clients use of our services at our own discretion.
XI. Multiple Accounts
Whilst utilising Hardwired Hosting UK Services, clients should hold no more than one account per individual, and one account per business or organisation. Clients who require more than one account should contact us for prior authorisation.
XII. Affiliates System
By utilizing our affiliates system, clients agree to use the system legitimately, clients may not spam (or falsely advertise to) others, additionally, clients may not use the affiliates system to refer themselves or duplicate accounts.
Hardwired Hosting UK currently offer a 10% recurring commission for each service referred to us, Hardwired Hosting UK reserve the right to modify the given commission at any time. A commission is paid into the affiliate balance after 15 days of referral if the referred client requests a refund in the first 14 days under our money back guarantee; the referrer will not receive their commission. Additionally, if a client is to dispute or charge back their payment, the referrer will have their commission for the service removed.
Clients will need to withdraw their commission funds from their Affiliates account into their client credit balance; the minimum withdrawal amount is currently £10.
XIII. Updates to Our Policies
Hardwired Hosting UK reserve the right to update our policies at any time, with or without prior warning to our clients or users.
